Intellimuse App Terms of Service

These Terms of Service ("Terms") govern your use of the Intellimuse App ("the App"), provided by IntelliMuse LLC. ("we," "us," or "our"). By accessing or using the App, you agree to be bound by these Terms. If you do not agree with these Terms, you must not use the App.

1. Applicability and Acceptance

  • 1.1. These Terms constitute a legally binding agreement between you and IntelliMuse LLC.. By using the App, you represent that you have read, understood, and accepted these Terms.
  • 1.2. You must be at least 18 years old or the legal age of majority in your jurisdiction to use the App. By accessing or using the App, you affirm that you meet this requirement.

2. Intellimuse App and AI Personas

  • 2.1. The Intellimuse App utilizes artificial intelligence technology to provide engaging and contextually appropriate conversations with AI personas or characters known as "Intellimuses." These Intellimuses are designed to mimic specific individuals and possess their own unique personalities, expertise, and communication styles.
  • 2.2. The Intellimuses, including their personalities, expertise, and communication styles, are for entertainment and informational purposes only. They do not constitute professional advice, opinions, or endorsements. We do not guarantee the accuracy, completeness, or usefulness of the information provided by the Intellimuses.
  • 2.3. The Intellimuses' responses are generated using the ChatGPT API or similar technology, which employs machine learning algorithms. While we strive to ensure the Intellimuses' responses are aligned with their intended characteristics, we do not guarantee that the responses will always adhere to the desired personas or communication styles.
  • 2.4. The App may offer options to adjust parameters like top_p and max_tokens to influence the creativity and adherence of the Intellimuses' responses. It is your responsibility to use these options appropriately, understanding that modifying these parameters may affect the behavior of the Intellimuses.

3. User Responsibilities and Conduct

  • 3.1. You are solely responsible for your use of the App and any consequences arising from it. You must comply with all applicable laws and regulations while using the App.
  • 3.2. You agree to use the App in a manner that is lawful, respectful, and does not infringe upon the rights of others. You must not use the App to generate or transmit any harmful, offensive, defamatory, or misleading content.
  • 3.3. You acknowledge that the Intellimuses' responses are generated by artificial intelligence algorithms and may not always be accurate, reliable, or suitable for your specific circumstances. Therefore, you should exercise caution and seek professional advice when relying on any information obtained through the App.
  • 3.4. You understand and accept that we do not assume liability for any actions, decisions, or consequences resulting from your use of the App or the information provided by the Intellimuses.

4. Intellectual Property

  • 4.1. The App and its content, including but not limited to text, graphics, images, logos, and software, are the intellectual property of IntelliMuse LLC. or its licensors. You may not copy, modify, distribute, sell, or lease any part of the App or its content without our prior written consent.
  • 4.2. You retain ownership of any content you submit or provide through the App. By using the App, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and distribute such content for the purpose of providing and improving the App.

5. Limitation of Liability

  • 5.1. To the maximum extent permitted by applicable law, IntelliMuse LLC. and its affiliates, directors, officers, employees, and agents shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or in connection with your use of the App or the information provided by the Intellimuses.

6. Indemnification

  • 6.1. You agree to indemnify, defend, and hold harmless IntelliMuse LLC. and its affiliates, directors, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys' fees, arising out of or in connection with your use of the App, your violation of these Terms, or your infringement of any rights of another person or entity.

7. Termination

  • 7.1. We may, at our sole discretion, suspend or terminate your access to the App at any time and for any reason, without prior notice or liability.
  • 7.2. Upon termination, all provisions of these Terms that should reasonably survive termination shall remain in full force and effect.

8. Modifications to the Terms

  • 8.1. We reserve the right to modify these Terms at any time. Any modifications will be effective immediately upon posting the updated Terms on the App. By continuing to use the App after the modifications, you accept and agree to the updated Terms.
